After the form has been completed the principal will need to figure out the signing requirements in their State to finalize the document. In addition, the principal will need to gather the agent (s) as they will be required to sign the form in front of either the two (2) witnesses or notary public.

In a property transaction, a POA will be filed by the realty agent in the appropriate real estate records as proof that the agent had the right to sign the deed in the principal’s name.
Witnessed (in some states) Notarized by a notary licensed in your state. The process of notarization is the most important legal step you need to take when you sign a POA. The notary’s job is to: Verify your and the other signing party’s identity.
This can happen if there is a dispute, and court supervision can be requested by: The principal— if he or she is unsure about the agent’s actions. The agent—if he or she faces challenges to the POA.
Courts do not normally have to be involved in the administration or execution of a POA. Generally, the principal can grant a power of attorney without having to present it to a court to have it validated. There may be occasions when a court is asked to inspect and rule over parts of a POA.

The law governing the requirements for a POA changed effective June 13, 2021. Any POA executed on or after June 13, 2021, must comply with the new requirements under New York’s General Obligations Law, Article 5, Title 15.

POAs executed before June 13, 2021, will be reviewed in accordance with the laws in effect at the time the POA was executed. POAs executed on or after June 13, 2021, that use an old Statutory POA form or otherwise do not comply with the requirements of the new law, will be invalid. All POAs executed on or after June 13, 2021, must be signed by 2 disinterested witnesses (witnesses who are not listed as an agent in the POA or named in the POA as a person who can receive gifts). The use of a Statutory Gift Rider (SGR – an attachment to the POA) to grant gifting authority has been eliminated.
If you have an approved POA on file with NYSLRS, you do not need to send a new one.
