In October 2014, Wilson, defending state law asked the Supreme Court of South Carolina to intervene to stop same-sex marriage licenses from being issued in South Carolina after the 4th Circuit Court of Appeals issued a ruling striking down state bans on same-sex marriage. The 4th Circuit has jurisdiction over South Carolina.
In January 2021, Wilson faced a disciplinary complaint after making a filing urging the U.S. Supreme Court to challenge election results in four states won by then-candidate Joe Biden in the presidential election; Wilson later acknowledged Biden as the election's winner.
In February 2013, Wilson originally admitted his campaign failed to disclose and report receiving at least 15 separate contributions of unknown amounts. A further investigation completed in March 2013 revealed at least 68 unreported contributions and 16 unreported expenditures.
Wilson graduated from Francis Marion University with a bachelor's degree in political science in 1996, and received a J.D. from the University of South Carolina School of Law in 2002. Following college, he joined the South Carolina National Guard. He is currently a Colonel in the Judge Advocate General Corps.
Henry McMaster did not run for reelection as Attorney General, choosing instead to run for governor, as incumbent Mark Sanford was term limited. Wilson won the GOP nomination in a runoff election on June 22, 2010, receiving 60 percent of the vote against his opponent Leighton Lord.
The Supreme Court voted 9-0 to reject the Texas lawsuit, which sought to invalidate the votes in Georgia, Wisconsin, Michigan and Pennsylvania. Still, Wilson using his official position to raise doubts about the integrity of the 2020 election “was reckless and anti-democratic with ruinous consequences,” Kenney wrote.
But just a month ago, Wilson made a Dec. 9 filing that encouraged the U.S. Supreme Court to consider a lawsuit brought by the Texas attorney general that challenged the election results in four key battleground states that Biden won, Kenney wrote.
The filing comes a day after Wilson’s former aide, Adam Piper, resigned as executive director of the Republican Attorneys General Association amid revelations the group sent a robocall encouraging “patriots” to march on the Capitol and demand Congress overturn the election results.
John Freeman , a University of South Carolina School of Law professor emeritus, read Kenney’s complaint and said it appears to have merit. Attorneys, and especially the top law enforcement official in South Carolina, are supposed to have proof and evidence to back up serious claims they make in legal filings, Freeman said.
Kenney’s filing notes that in recent days Wilson has acknowledged Biden is the legitimate winner of the 2020 election and that he is unaware of any evidence presented in court to substantiate allegations of election fraud.
