Rittenhouse's lead attorney, Mark Richards, suggested in his closing statement that prosecutors long knew they had a faulty case against Rittenhouse and lacked evidence that the then-17-year-old provoked the shootings.
Richards said the soot indicated that Rosenbaum had been reaching for Rittenhouse's gun.
Prosecutors responded by accusing Richards of "gloating and boasting at his client's kills."
Binger labeled Rittenhouse an "active shooter" and alleged he had been the initial aggressor who provoked the deadly encounter with Rosenbaum by pointing his gun at Rosenbaum's associate, Joshua Ziminski. Binger said Rosenbaum was unarmed and never posed any threat to Rittenhouse , and called the defense's theory that Rosenbaum could have grabbed Rittenhouse 's rifle "cockamamie."
Richards added that prosecutors never reassessed their case against Rittenhouse as they obtained more evidence throughout their investigation — particularly the video footage that shows all three men pursuing Rittenhouse. He even chastised police for failing to obtain and investigate Grosskreutz's cellphone even though they had secured a warrant for it (prosecutors said they were following their interpretation of Marsy's Law, a Wisconsin constitutional amendment protecting crime victims' rights).
At one point he called Assistant District Attorney Thomas Binger "the person who's made it his goal of putting my client's head on his wall."

Ongoing trial. On August 25, 2020, amid the Kenosha unrest, Kyle Rittenhouse, a then 17-year-old from Antioch, Illinois, shot and killed two people and wounded another during multiple confrontations at two locations. He was armed with a Smith & Wesson M&P15 rifle, and one of the individuals shot by Rittenhouse had a handgun.
Kyle Rittenhouse, the Illinois teenager accused of shooting and killing protesters in Kenosha, Wis., was charged on Thursday with six criminal counts including felony charges of first-degree reckless homicide, first-degree intentional homicide and attempted first-degree intentional homicide.
Then, according to Kenosha County prosecutors, Rosenbaum engaged Rittenhouse and tried to take his rifle from him. Rittenhouse then fired four shots, hitting Rosenbaum in the groin, back, and left hand. The bullets fractured Rosenbaum's pelvis, perforated his right lung and liver, and caused additional minor wounds to his left thigh and forehead. Rittenhouse remained near Rosenbaum as McGinniss began administering first aid. Rittenhouse then made a phone call and was heard saying "I just killed somebody," and then fled as more protesters arrived. Rosenbaum died shortly afterwards.
By December 17, 2020, this funding had reached around $586,000.
Prosecutors say that he was required to file an address change within 48 hours of moving. Rittenhouse's attorney said that Rittenhouse had been staying at an undisclosed address out of concern for his safety. His team had offered to provide the new address to prosecutors if they could guarantee its secrecy from the public, but the district attorney had declined on the grounds that the information is public record. The district attorney told Rittenhouse's attorneys they could move for the judge to seal the public record, but they never filed such a motion. Prosecutors asked for a $200,000 increase in Rittenhouse's bond. Judge Bruce Schroeder denied the prosecutors requests at a hearing on February 11, stating that people out on bail often fail to update their address without being arrested.
The Kenosha protests included rallies, marches, property damage, arson, and clashes with police.
The Michigan National Guard, Arizona National Guard, and Alabama National Guard all sent troops to assist. President Donald Trump visited Kenosha on September 1, 2020, to see the damage caused by the unrest and to praise law enforcement.
