Bush and Paxton each have unique histories with Trump. Bush endeared himself to Trump by emerging as the only prominent member of his famous political family to support the former president.
Afterward, Bush spokesperson Karina Erickson said Bush and Trump "discussed the critical need for putting the best team on the ballot so that the Republican Party can restore conservative principles and freedoms to our country.". Trump's statement Tuesday was first reported by CNN.
Paxton has been one of the most pro-Trump attorneys general — especially in the aftermath of the November election, when he launched a lawsuit challenging Trump's reelection loss in four battleground states. Bush has said the state's top law enforcement official "needs to be above reproach.".
Small wonder that Pelosi was desperately trying to get Pence to invoke the 25th Amendment.
However, even Brandenburg would treat Trump’s speech as protected by the First Amendment. Under that case, the government can criminalize speech that is “directed to inciting or producing imminent lawless action and is likely to incite or produce such action.”.
For a court, the speech notably does not include a direct call for lawless action by Trump. Instead, there was a call for a protest at the Capitol. Moreover, violence was not imminent; the vast majority of the tens of thousands of protesters present were not violent before the march, and most did not riot inside the Capitol. Like many violent protests we have witnessed over the last four years, including Trump’s 2017 inauguration, the criminal conduct was carried out by a smaller group of instigators.
Walter, Pelosi did all but beg Republicans to get Trump to resign or Amendment 25 him so she could call it off. This was not in the Democrats interests but a matter of principle.
