He's served about a year of his 15-year-prison term and is housed at Riverbend Maximum Security Institution in Nashville.
In November 2016, after being convicted Vandenburg was sentenced to 17 years in prison; after he gets out he will be required to be listed on the sex-offender registry for the rest of his life. He is serving his time in Morgan County Correctional Complex.
23Vandenburg, 23, had previously been found guilty in a joint trial alongside Batey, but those verdicts were thrown out due to juror misconduct, leading to separate retrials.
Vandenburg, now 26, was one of four former Vanderbilt football players charged in the rape case that rocked the city. He faced trial on the charges twice after the judge ordered a retrial because of issues with a juror. Vandenburg; Cory Batey, 25; and Brandon Banks, 25 were ultimately convicted of aggravated rape.
Vandenburg was eventually sentenced to 17 years in prison. Batey and Banks were each sentenced to 15 years in prison, and McKenzie was sentenced to 10 years of probation as part of a plea deal, according to a 2018 New York Post article.
A woman raped by former Vanderbilt University football players while she was unconscious in June 2013 chose not to attend a third sentencing hearing in the case Friday. In that hearing, Brandon E. Banks, 23, was sent to prison for 15 years for his convictions of aggravated rape and aggravated sexual battery.
Batey, 27, is now in Riverbend Maximum Security Institution, where he was incarcerated after finding guilty in aggravated rape, facilitation of aggravated rape, two counts of attempted aggravated rape, and three counts of aggravated sexual battery
In her testimony, Vanderbilt's victim said that the damage caused by the incident she faced is immeasurable and will not be understood by anyone. She was treated like flesh. Her reputation was shredded to pieces.
The victim, who is now a 23-year-old student at Vanderbilt University, said she felt “betrayed” by the decision to release him from jail before he appeals. “You’re letting someone who caused me pain and humiliation and shame walk free,” she told The Tennessean. “I would not feel safe with him walking on the street.”
Batey is currently serving time at Tennessee State Prison. The address for the prison is: 2408 Rhea Road, Nashville, TN 37218. After his release from prison, he will have to register as a sex offender for life.
If released on parole, there are restrictions that would prevent him from living near campus and attending any school sponsored event. Cory Batey is not eligible for parole until he has served at least 60 percent of his sentence, meaning that it’s possible that he could be released in 2024.
Vandenburg and Batey were released on bond Wednesday after the judge granted their attorneys’ request to re-instate the bail, set at $350,000 each. The judge added $50,000 to Vandenburg's bond, citing the fact that Vandenburg lives out of state, in California, and citing Vandenburg's additional misdemeanor offense since the initial bail was set.
The ruling entitles the men to a new trial, though prosecutors can appeal.
