Under Kentucky law, the responsibilities of my office include serving as the legal adviser to the Campbell County Fiscal Court, collecting court-ordered child support payments, and prosecuting all misdemeanor crimes in the county, including DUIs, assaults, bad checks, thefts, juvenile offenses, and a multitude of other statutory offenses.
The city attorney is also a prosecutor for misdemeanors committed in L.A. — think public nuisances, petty shoplifting, vandalism and the like. (Felonies are handled by the county district attorney, as are any type of crime committed in unincorporated parts of L.A. County.)
This also means the city attorney can choose which cases not to prosecute and which to refer to diversion programs (in which defendants can avoid trial and potential jail time by doing certain programs like drug treatment or therapy) instead. When the City Council proposes a law, the city attorney actually writes the law.
The city attorney is essentially the head of a very, very big law firm. Fernando Guerra, professor of political science at Loyola Marymount University, says he would consider a candidate’s “experience as a lawyer representing government entities, experience running large institutions, and experience in conflict resolution.”
In June, Campbell, 57, filed an age and race discrimination complaint against the city with the Nevada Equal Rights Commission.
Jack Campbell was fired by City Attorney Karl Hall shortly after an investigation found Campbell had made a joke containing a slur against lesbians shortly after a deposition of a female police officer who had filed a grievance against the city. Campbell said he was never disciplined for that incident after he apologized to the employee . He said he didn’t realize she would take offense to the action because they had a friendly relationship. “I was learning Italian and rattled off a bunch of Italian and she said, ‘I don’t understand it,’” Campbell said.
Campbell worked as the city’s risk manager and also represented the police department. According to city documents, an outside law firm investigating the officer’s complaint found Campbell had made the remark within earshot of the officer and others, violating the city’s policy prohibiting rude and discourteous conduct.
Campbell said he is Native American, which prompted him to file the race discrimination portion of the complaint. “My office is full of Native American memorabilia,” he said. “The only conversation I ever had with Karl, (before he was fired) was we talked about my Native American heritage.”.
