Eminent domain is the right of the government to take private property and convert it to public use. Condemnation is the process by which a government agency can exercise this power. These processes are rooted in the Constitution. The Fifth Amendment requires government to pay landowners “just compensation.”
Inverse Condemnation Eminent domain is initiated by the government. By contrast, inverse condemnation is initiated by the property owner when the government exacts a taking without following the eminent domain procedures. These are often land-use disputes in which a property owner challenges development restrictions.
The U.S. Supreme Court has ruled that states can place restrictions on their ability to use eminent domain, and that's just what Georgia has done. The state's constitution was amended in 2006 to require that if eminent domain is used for redevelopment purposes, it must be for public use.
