These Guidelines are issued under the authority of the Attorney General as provided in sections 509,510,533, and 534 of title 28, United States Code, and Executive Order 12333. They apply to domestic investigative activities of the Federal Bureau of Investigation (FBI) and other activities as provided herein.

The FBi is vastly more powerful than CIA, especially with regard to ordinary Americans. They primarily operate in the US and have the power of arrest. Their mandate is much wider than the CIA's and they have far greater discretion in following the law as there is no one to really investigate them.
The Department of JusticeThe Department of Justice is the law enforcement agency with the most power in the United States. In fact, its job is to enforce federal laws. The Department of Justice is lead by the attorney general, a cabinet-level official who is appointed by the president. The FBI is part of the Department of Justice.
The guidelines provide uniform standards, to the extent possible, for all FBI investigative and intelligence gathering activities. They are designed to provide a single, consistent structure that applies regardless of whether the FBI is seeking information concerning federal crimes, threats to national security, foreign intelligence matters, or some combination thereof. The guidelines are the latest step in moving beyond a reactive model (where agents must wait to receive leads before acting) to a model that emphasizes the early detection, intervention, and prevention of terrorist attacks, intelligence threats, and criminal activities. The consolidated guidelines also reflect the FBI’s status as a full-fledged intelligence agency and member of the U.S. Intelligence Community. To that end, they address the FBI’s intelligence collection and analysis functions more comprehensively. They also address the ways in which the FBI assists other agencies with responsibilities for national security and intelligence matters.
Approximately 18 months ago, the FBI requested that the Attorney General consider combining three basic sets of guidelines—the General Crimes Guidelines, which were promulgated in 2002, the National Security Investigative Guidelines (NSIG), which were promulgated in 2003, and a set of guidelines that are called the Supplemental Foreign Intelligence Guidelines, which were promulgated in 2006.
In addition to the need to issue more consistent standards, the FBI’s critical involvement in the national security area presents special needs for coordination and information sharing with other DOJ components and federal agencies with national security responsibilities. Those components and agencies include the Department’s National Security Division, other U.S. Intelligence Community agencies, the Department of Homeland Security, and relevant White House agencies and entities. In response to this need, the notification, consultation, and information-sharing provisions that were first adopted in the 2003 NSIG are perpetuated in the new guidelines.
The new guidelines take seriously the need to ensure compliance and provide for meaningful oversight to protect privacy rights and civil liberties. They reflect an approach to oversight and compliance that maintains existing oversight regimes that work and enhances those that need improvement.
The FBI may engage in undercover activities and undercover operations pursuant to theseGuidelines that are appropriate to carry out its law enforcement responsibilities, including theconduct of preliminary inquiries, general crimes investigations, and criminal intelligenceinvestigations. In preliminary inquiries, these methods may be used to further the objective ofinquiry into possible criminal activities by individuals or groups to determine whether a fullinvestigation is warranted. In general crimes investigations, these methods may be used tofurther the investigative objectives of preventing, solving, and prosecuting crimes. In criminalintelligence investigations – i.e., racketeering enterprise investigations and terrorism enterpriseinvestigations – these methods may be used to further the investigative objective of ascertainingsuch matters as the membership, finances, geographical dimensions, past and future activities,and goals of the enterprise under investigation, with a view to the longer range objectives ofdetection, prevention, and prosecution of the criminal activities of the enterprise.

An undercover operation approved by FBIHQ may not continue longer than isnecessary to achieve the objectives specified in the authorization, nor in any event longerthan six months, without new authorization to proceed, except pursuant to subparagraph
The Undercover Review Committee shall consist of appropriate employees of the FBIdesignated by the Director and Criminal Division attorneys designated by the AssistantAttorney General in charge of the Criminal Division, DOJ, to be chaired by a designee ofthe Director.
“Undercover Activities” means any investigative activity involving the use of anassumed name or cover identity by an employee of the FBI or another Federal, state, orlocal law enforcement organization working with the FBI.
Entrapment occurs when the Governmentimplants in the mind of a person who is not otherwise disposed to commit the offense thedisposition to commit the offense and then induces the commission of that offense in order toprosecute.
The alternative requirements of paragraph B(4), while not required by law, are imposedto ensure the Government does not offer inducements to crime to persons who are notpredisposed to do so . These standards can be waived only by the Director upon a written findingthat the activities are necessary to protect life or prevent other serious harm.
