I think there is a difference in respect to Attorney Fees for NOD filed after 2007: If the NOD was received on or after June 20, 2007, the finance activity must withhold an assessment from the attorney/agent’s payment.
Dec 29, 2016 · A VA disability attorney does not charge hourly rates to represent veterans on appeal. Most cases are taken on a contingency basis, which means they only get paid on the contingency that you win on appeal. If you get an award for back pay, which includes an award for higher benefits, the attorney receives a percentage of that award as their fee.
The actual collection of the assessment amount does not occur until amounts withheld for fees are released and this in turn is dependent on whether there is an appeal on the fee eligibility decision as provided in M21-1, Part I, 3.5. However the AAFC must calculate the assessment at the time the fee decision is made.
A fee agreement that does not clearly specify that VA is to pay the agent or attorney out of past‑due benefits or that specifies a fee greater than 20 percent of past‑due benefits awarded by VA shall be considered to be an agreement in which the agent or attorney is responsible for collecting any fees for representation from the claimant without assistance from VA.
I have an atty representing me since April 2015, but looks like they put in the paper work for atty fee eligibility today and then it posted on ebenefits. But why would it show up today if the claim was not granted. It must have been granted. They just wont tell me until I reiceved the letter right?
When I first filed my claim, I filed with (VSO) Purple Heart. They did "Absolutely Nothing" for me other than file my claim. They even screw that up by not filling out all the information correctly. After it was denied , I took it back to them, and they told me it would be 5 years for the appeal process. So I found an atty to appeal my claim.
the difference is my case, is that its being (decided and rated) by the DRO at the RO.
