DUTIES OF THE OFFICE OF THE COUNTY ATTORNEY 1 The County Attorney prosecutes the following cases: 2 All misdemeanor offenses: DWI 1 st & 2 nd, Theft under $2500, Assault with Bodily Injury, Driving While License Invalid, Criminal Trespass, Criminal Mischief under $2500, Possession of Marijuana, Possession of Dangerous Drug, Evading Arrest, Resisting Arrest, Terroristic Threat 3 Juvenile Offense, both misdemeanor and felony (a person is considered a juvenile in the criminal justice system if they are 10 years or over but under 17 years of age 4 All Class C misdemeanor offense filed with the Justice of the Peace (traffic tickets) 5 All Child Protective Services cases 6 All Adult Protective Services cases 7 Protective Orders 8 Mental Health 9 Collection of Hot Checks 10 The County Attorney also acts as an advisor to the Erath County Commissioner’s Court. The County Attorney works with law enforcement officers in the investigation and preparation of cases to be heard before the criminal courts. When requested in writing, the County Attorney also provides legal counsel to county entities.
Other duties include: prosecution of juvenile offenders, representation of victims of violence in protective orders, assisting the Texas Department of Family and Protective Services in placement reviews, prosecution in the Justice of the Peace Courts, and bond forfeitures.
