Huber is the only U.S. attorney to be appointed by both President Barack Obama and President Donald Trump. His resignation comes as the Justice Department this week asked U.S. attorneys who were appointed by Trump to resign as the Biden administration moves to transition to its own nominees.
Obama first appointed Huber in February 2015, with the backing of now-retired Republican Utah Sen. Orrin Hatch. The Senate confirmed Huber in June and he took the oath of office in August 2015.
Huber submitted his resignation in March 2017. Trump nominated him to keep the job in June of that year and the Senate confirmed him in August.
His last day is Feb. 28.

Last year, Huber was involved in a large effort, called “Operation Reboot, ” which ensured sex offenders were properly registered. He said the success of the operation showed that calls to defund police departments were “ludicrous.”.
Huber said in 2018 that they were aiming to incarcerate the worst offenders and stop the revolving door of criminals going in and out of Utah’s jails and state prison. Some critics said this approach, however, could lead to over-incarceration of people who commit minor crimes.
But Huber threw his support behind several Trump initiatives, including tougher punishments for people who re-enter the U.S. illegally and blocking some federal funds from going to so-called “sanctuary” cities.
His last day will be Feb. 28.
Utah has only one federal district. Highlights of Huber’s tenure include battling with Rep. Phil Lyman over restitution payments when Lyman, a former San Juan County commissioner, was convicted of a misdemeanor after leading a ATV protest down Recapture Canyon.
SALT LAKE CITY, Utah – U.S. Attorney for the District of Utah John Huber announced he will resign from his position, effective Feb. 28. The announcement, made Wednesday, came after Justice Department officials said they would ask U.S. attorneys who were appointed by former President Donald Trump to resign from their posts.
Huber had served in his position since 2015, beginning with two years as a presidentially appointed U.S. Attorney during the Obama administration. In August 2017, the U.S. Senate unanimously confirmed President Donald J. Trump’s appointment of Huber to serve for another four years.
U.S. attorneys serve at the pleasure of the president and are generally nominated with a recommendation from a home-state senator. The 93 U.S. attorneys are responsible for overseeing offices of federal prosecutors and charged with prosecuting federal crimes in their jurisdictions.
BANKS GRANTED POWER TO SEIZE YOUR ACCOUNTS. In April, Barr appointed another US Attorney John Durham, to take over part of Huber’s investigation. AG Barr said he selected Durham because the other special investigator Michael Horowitz has limited investigative powers.
Barr said, “He [Horowitz] doesn’t have the power to compel testimony, he doesn’t have the power really to investigate beyond the current cast of characters at the Department of Justice,” Barr said. “His ability to get information from former officials or from other agencies outside the department is very limited.”.
A source familiar with Durham’s investigation told Fox News on Thursday that parts of what Huber was investigating in 2017 -- involving the Clinton Foundation -- have been incorporated in Durham’s investigation.
In November 2017, then-Attorney General Jeff Sessions directed Huber, the U.S. attorney for Utah, and other senior prosecutors to evaluate “certain issues” involving the sale of Uranium One, and other dealings related to the Clinton Foundation. Sessions tapped Huber after requests by congressional Republicans, who had been calling for the appointment of a special counsel to review the matters.
Durham was appointed by Attorney General Barr last year to investigate the origins of the FBI’s Russia probe shortly after Mueller completed his yearslong investigation into whether the campaign colluded with the Russians to influence the 2016 presidential election.
Two sources familiar with Durham’s investigation told Fox News at the time that Durham was working expeditiously to try to finish the probe before Labor Day — which he did not — but that several lines of the investigation had not yet been completed. “He believes it’s critical to do them,” one source said at the time.
