(b) A principal may revoke a Wisconsin basic power of attorney for finances and property and invalidate it at any time by destroying it, by directing another person to destroy it in the principal's presence or by signing a written and dated statement expressing the principal's intent to revoke.
The death, incapacity or bankruptcy of the donor or sole attorney will automatically revoke the validity of any general power of attorney (GPA). GPAs can be revoked by the donor at any time with a deed of revocation. The attorney must also be notified of the revocation or the deed of revocation won't be effective.
A power of attorney can be revoked at any time, regardless of the termination date specified in the document, as long as the donor is mentally capable. (Note: there are some exceptions, but these apply only to "binding" Powers of Attorney. LawDepot does not provide forms for binding Powers of Attorney on our web site).
If you decide that you want to cancel / revoke a PoA that is registered with us, you will need to tell us. A PoA can only be cancelled / revoked by you, the granter, if you are capable of making and understanding this decision. We do not charge a fee to cancel a PoA.
Such Power of Attorney may be revoked by the principal or the Power of Attorney holder by the procedure according to law. You can cancel or amend the Enduring Power of Attorney at any time while you are mentally capable. For example if the attorney you have chosen dies or becomes incapable or no longer wishes to act on your behalf you will need to appoint a new attorney.
You may wish to dispute a Power of Attorney if you consider the power has been granted to the wrong person or the individual did not have the necessary capacity to make the power of attorney.
