Check your document for clarity. It must specifically name the principal, the agent (the person given power), and the type of powers granted. A power of attorney can provide broad powers or it can narrowly tailor the agent's responsibility. Make sure the form stipulates whether the powers are "springing," "durable," or "springing durable."
Check the power of attorney records at the register or recorder of deeds in the county where the individual who created the instrument resides. In some states a power of attorney can be filed with the register or recorder of deeds.
While you don’t need a lawyer for a power of attorney form, you should be aware that if you create an ambiguous legal document it may have difficulty holding up in court. Thus it is at least sensible to have an expert power of attorney lawyer review your document should you decide to create one on your own.
Apply to search the Office of the Public Guardian ( OPG ) registers to see if someone has another person acting on their behalf. This can be: an attorney under a lasting power of attorney. an attorney under an enduring power of attorney.

In order to make a power of attorney, you must be capable of making decisions for yourself. This is called having mental capacity – see under heading, When does someone lack mental capacity? You can only make a power of attorney which allows someone else to do things that you have a right to do yourself.
You cannot give an attorney the power to: act in a way or make a decision that you cannot normally do yourself – for example, anything outside the law. consent to a deprivation of liberty being imposed on you, without a court order.
