The PoA can only be amended by you, the granter, if you are capable of making and understanding this decision. Examples of amendments that can be made are: Removing power(s) from the PoA. Add an attorney, this could either be a joint or a substitute attorney.
General power of attorney GPAs can be revoked by the donor at any time with a deed of revocation. The attorney must also be notified of the revocation or the deed of revocation won't be effective.
If you have made and signed a Power of Attorney such as a Lasting Power of Attorney or an Ordinary Power of Attorney, you are perfectly within your rights to cancel it. Witnessing and Notarization Requirement To make a POA in Illinois, you must sign the POA in the presence a notary public and at least one witness. The notary public cannot act as the witness.
It is not possible to amend an EPA or LPA once signed. Any changes would require a new document. However a change of address does not require an updated document. A power of attorney can be revoked at any time, regardless of the termination date specified in the document, as long as the donor is mentally capable. (Note: there are some exceptions, but these apply only to "binding" Powers of Attorney.
If you decide that you want to cancel / revoke a PoA that is registered with us, you will need to tell us. A PoA can only be cancelled / revoked by you, the granter, if you are capable of making and understanding this decision. We do not charge a fee to cancel a PoA.
