Jurors expect the lawyers to know and understand their case. In fact, many of them come into the courtroom expecting that at least one of the lawyers knows the truth, but will try to fool them anyway because that’s what their client is paying them to do.
A better form of feedback for some lawyers is a meeting with the judge. S/he may not choose to meet with you, but you may be surprised how many will agree to meet with you for a few minutes in chambers to discuss your strengths and weaknesses—at least as s/he saw them in that particular trial.

Like all new lawyers, I knew nothing at the time about trial. So to develop my own trial skills, I started by asking the other lawyers in my law firm to give me their worst cases for trial. I wanted the cases that no one else wanted. I wanted the “stinkers.” I wanted the cases that everyone thought I should lose.

So trust me, none of this has happened because of any innate gifts. It came from thousands of hours of study. And if there is any advice I can give to young lawyers, it is this: you must invest in yourself, and make this investment in yourself your top priority.

It may come as a surprise, but most successful people do not focus on worst-case scenarios, they focus on the best thing that can happen. Admittedly, if you are stressed, angry or depressed, it is difficult to focus on positive thoughts.
Be alert and try to read what the judge is really asking before deciding whether an argument or question is really necessary. Learning from trial textbooks is critical to preparing for trial, but be practical in your approach and be prepared for the unexpected. Ask for help from those who have been through a trial.
Prepare closing argument ahead of time. Your closing argument should cite the evidence and law that supports your theme and the merits of your case. Do not wait until trial begins to prepare your closing argument.
Lawyers are busy. And many lawyers won’t take the time to read a large book. But if they get something practical to improve their skills or their business in just a few minutes, that may be something they are more inclined to read.
