Dear Mr. Lawyer, I have decided to terminate our current legal relationship immediately and have accepted legal counsel elsewhere. I am terminating this relationship because I have been calling your office for three months and have received no updates on my case status.
Legal malpractice is a type of negligence in which a lawyer does harm to his or her client. Typically, this concerns lawyers acting in their own interests, lawyers breaching their contract with the client, and, one of the most common cases of legal malpractice, is when lawyers fail to act on time for clients.
Throughout the process of getting your financial settlement after becoming injured, there may be periods of time that you do not hear from your attorney. Although this can be unnerving, it is a normal part of the legal process.
9 Taboo Sayings You Should Never Tell Your LawyerI forgot I had an appointment. ... I didn't bring the documents related to my case. ... I have already done some of the work for you. ... Perhaps the most common kinds of complaints against lawyers involve delay or neglect. This doesn't mean that occasionally you've had to wait for a phone call to be returned. It means there has been a pattern of the lawyer's failing to respond or to take action over a period of months.
As a general rule, give your lawyer 1-2 days to return your non-urgent phone call; very often, your lawyer may be out of the office for a half-day, whole day, or longer if he/she is in court.
You should never be afraid or feel like an intrusion to contact your attorney every three weeks or so, or more frequently if there is a lot going on with your health or other matters related to your legal case. There is of course a limit to how much you should be contacting or sharing.
Their goal is to drag the case on and pay out as little as possible. This earns more money for the attorney, who gets paid by the hour, and also can help frustrate the plaintiff into making a better settlement for them out of desperation.
Once a case gets filed in court, things can really slow down. Common reasons why a case will take longer than one would hope can include: Trouble getting the defendant or respondent served. The case cannot proceed until the defendant on the case has been formally served with the court papers.
If you have called your attorney, left messages, sent emails, and you still haven't heard a response, the best course of action is to send a certified letter to his or her office questioning the failure to communicate and informing them that you are prepared to find a new lawyer if the situation does not improve.
Returning a client's phone call is not an efficient use of their time. Often, if you get a return call at all it is a paralegal assigned to the case, and often this paralegal cannot answer many of the legal questions you may have.
A: The lawyer should be responsive to your questions within 24-48 hours after you left a message. If the lawyer is not responsive, perhaps he or she is on vacation and unable to return.
Rule 1.16 Declining or Terminating Representation. (a) Except as stated in paragraph (c), a lawyer shall not represent a client or, where representation has commenced, shall withdraw from the representation of a client if: (1) the representation will result in violation of law or the Rules of Professional Conduct; ...
CPR 269. An attorney whose motion to withdraw from representation of a corporation is denied must continue to represent the corporation.
[4] A client has a right to discharge a lawyer at any time, with or without cause, subject to liability for payment for the lawyer's services. Where future dispute about the withdrawal may be anticipated, it may be advisable to prepare a written statement reciting the circumstances.
Opinion rules that a lawyer may not charge a client for filing and presenting a motion to withdraw unless withdrawal advances the client's objectives for the representation or the charge is approved by the court when ruling on a petition for legal fees from a court-appointed lawyer. 2009 Formal Ethics Opinion 8.
RPC 227. Opinion rules that a former residential real estate client is not entitled to the lawyer's title notes or abstracts regardless of whether such information is stored in the client's file. However, a lawyer formerly associated with a firm may be entitled to examine the title notes made by the lawyer to provide further representation to the same client.
The court may request an explanation for the withdrawal, while the lawyer may be bound to keep confidential the facts that would constitute such an explanation. The lawyer's statement that professional considerations require termination of the representation ordinarily should be accepted as sufficient.
Withdrawal is also permitted if the lawyer's services were misused in the past even if that would materially prejudice the client. The lawyer may also withdraw where the client insists on taking action that the lawyer considers repugnant or imprudent or with which the lawyer has a fundamental disagreement.
If you fire your lawyer just before a hearing or trial, you’ll most likely need to file a “motion for continuance.” A motion for continuance asks the judge to change the date of the court hearing or trial to a later date so you have time to hire a new attorney. The judge doesn’t have to grant your motion. If the judge denies your motion, you’ll need to represent yourself in the hearing or trial.
Most state bar associations offer free services to help clients resolve issues with their lawyers.
Deciding whether to terminate an attorney-client relationship is a personal decision. Sometimes the lawyer isn’t a good fit and you’re better off moving on. Other times, the attorney-client relationship isn’t perfect but it’s strong enough to get the job done.
Always terminate the relationship in writing. Even if you fire your attorney in a verbal exchange, you should follow up by sending a written termination letter. Be sure to send the letter by “certified mail with return receipt requested” so there’s proof your lawyer received the letter. Taking these steps will ensure there’s no confusion about the status of the relationship.
Often, a polite conversation with your lawyer can clear up any issues between the two of you. Remember, your lawyer has an incentive to keep you (a paying customer) happy. In some cases, simply making your attorney aware that there’s an issue is all it takes to resolve the problem.
This doesn’t mean your lawyer can guarantee that they’ll win your case, but it does mean your lawyer should have the competence to represent you effectively and professionally. Failure to follow client instructions.
Lack of communication. Your lawyer must be willing and able to communicate effectively with you. If you ask for an explanation, your lawyer should provide it within a reasonable time. If your lawyer is ignoring you, it may be time to hire a different lawyer. Unreasonable fees.
For example, if your lawyer knows when your accident happened and when the statute of limitations runs out, yet still fails to file a claim in the allotted time period, you might no longer be able to file the claim or have legal recourse.
Reason #1: Your lawyer isn’t returning your calls. Lack of communication is a big problem for some law firm clients. Yes, legal practices are very busy. They have lots of clients — not just you. However, before a lawyer signs on to take your case, they need to know if the firm has the capacity to handle it. There’s no excuse for not returning phone ...
If you have a meeting with your lawyer, there’s a good chance you took time off from work, secured childcare, or had other obligations that you changed or gave up in order to be at the meeting. Your lawyer shouldn’t waste your time, be unprepared, or mishandle your funds or documents.
Hire a new lawyer first, and then fire the old one. Write a termination letter. Any time you modify or terminate a contract, it must be in writing.
Your lawyer has a responsibility to act in an ethical manner. Beyond that responsibility, they’ve actually taken an oath to uphold certain ethics.
Before you hire an attorney, you’ll sign a contract that sets forth the lawyer’s fees. Most personal injury lawyers work on a contingency basis, which means they get paid a percentage of the damages you receive. However, they’re also going to charge you for additional expenses that come up while the case is in process.
Your lawyer likely knows the legal system in the community where you live, and they might have valid reasons why they think one approach is better than another, but ultimately it’s still up to you to make a decision — it’s your life, after all.
Personal injury lawyers in North Carolina generally work on a contingency basis. This means you are not charged for legal representation until the case is resolved by a settlement or damage award.
At Speaks Law Firm, we have been fired by clients before. And sometimes we have been hired by people who weren’t satisfied with their original choice of representation. It happens in every law practice.
