Under the ABA accredited program, to become a Certified Elder Law Attorney (CELA), an attorney must be licensed to practice law and have practiced law at least five years, demonstrate substantial involvement in Elder Law for the past year three years, have participated in 45 hours of legal education in Elder Law during the past three years, and pass a written examination.
· Provide references from lawyers and judges. · Pass a written examination covering the substantive and procedural law in the specialty area. · Demonstrate completion of at least 36 hours of continuing legal education courses in the specialty area in the three-year period proceeding the lawyer’s application for certification.

ABA accreditation signifies that a certifying organization’s program has been reviewed by the ABA and found to meet the Standards for Accreditation of Specialty Certification Programs for Lawyers.
Look for the statement, “Accredited by the American Bar Association to certify lawyers in the specialty area (s) of ____________” in the program’s descriptive materials or on the certificate furnished to your lawyers.
“Elder Law” is the legal practice of counseling and representing older persons and persons with special needs, their representatives and families about the legal aspects of health and long-term care planning, public benefits, surrogate decision-making, legal capacity, the conservation, disposition and administration of estates and the implementation of their decisions concerning such matters giving due consideration to the applicable tax consequences of the action, or the need for more sophisticated tax expertise.
Upon certification or re-certification, NELF shall notify the Supreme Court, or other appropriate authority in each jurisdiction in which the attorney is licensed to actively practice law, of the certification or re-certification and request notice of any future disciplinary action taken against the attorney.
1.1 NELF is dedicated to the development and improvement of the professional competence of lawyers in the area of elder law . The purpose of the certification procedure is to identify those lawyers who practice in this area, and who have the special knowledge, skills, experience and proficiency to be properly identified to the public as certified elder law attorneys.
The Supreme Court of New Jersey authorized the Board on Attorney Certification to administrate the state's program for certifying lawyers. The program sought to protect consumers from misleading advertising claims by creating an objective and reliable standard for specialization. The Minnesota State Bar Association (MSBA) established its specialty certification program for attorneys which offers board certification in four (4) specialty areas for lawyers practicing in Minnesota.
