There aren't many defenses to no registration. Either you were registered when you got the ticket, or you weren't. Assuming you weren't registered, I would suggest getting registered before the court date and taking the registration with you when you go to court. As has been stated, this is a non moving violation.

Derek Robert Haake

If you did not have your registration on you, most courts will accept documents that show you had registered your car before the citation was issued. Contact the court clerk, and ask what procedures there are to show that it was in fact done. Registration violations cohld be a minor issue, but could have other impacts with them.

Mathew T. Jett

Failure to register a motor vehicle isn't a moving violation, so there aren't any points assessed for this type of charge. Your best bet is to go get the car registered and bring the paperwork with you to court. If you did have the car registered at the time you got the ticket, bring proof of that and you can probably get the case dismissed.

Julie Ann Jacek Bookmiller

If the charge is serious enough to have the potential for jail time (not that you would be sentenced to it, just the potential in the maximum sentence), you would likely be entitled to a public defender. (I am making assumptions based on your statement that you are not a "wealthy kid").

Anthony Joseph Muhlenkamp

I agree with Mr. Jett. If you get in compliance that should result in a minimal fine. Just tell the judge that you've gotten the car registered and would like to talk to the prosecuting attorney. They should work with you.

John Steenwyk Avery

It depends. If the cop smelled (or said he smelled) MJ NJ case law gives him probable cause to search and the automobile gives him exigent circumstances. That was not always the law but has been for many years. In such a case you can not delay a search by calling your attorney.

Rixon Charles Rafter III

No, you have no statutory or Constitutional right to stop the police from searching until you can call the lawyer. The judge determines after the fact, what is legal, not your lawyer.

H. Scott Aalsberg

First you should ask your lawyer as he probably has more information about you and your case then we do. That being said you only have a right to a lawyer once you are under custodial interrogation, unfortunately if you wanted to call your lawyer you should have done that before the officer came to your window.

William J Popovich

No. You are allowed to refuse to answer questions except to produce identification. Later on a lawyer can see if the search was legal. You must obey the lawful instructions of the officer like getting out of your car and not interfering with the investigation...
